NCLAT scraps audit, reinstates Resolution Professional at Golden Tobacco

The Insolvency appellate tribunal NCLAT has set aside the directions of the NCLT for a forensic audit of Golden Tobacco, and a change in the resolution professional of the debt-ridden cigarette maker. Passing an order over a batch of petitions filed against the NCLT order, the National Company Law Appellate Tribunal also extended the timeline for completing the CIRP (Corporate Insolvency Resolution Process) of Golden Tobacco till October 17, 2025. Besides, the appellate tribunal has also directed the NCLT to decide over the claims of financial creditors -- Central Bank of India, Arrow Engineering and others and then to reconstitute the lenders' body -- Committee of Creditors (CoC). "The direction of the Adjudicating Authority to conduct a forensic audit by KPMG is set aside," said a two-member bench comprising Chairperson Justice Ashok Bhushan and Member Barun Mitra. Golden Tobacco to challenge Rs 80.71-crore penalty before ITAT

NEW DELHI: Dalmia Group firm Golden Tobacco Ltd today said it will challenge Rs 80.71-crore penalty confirmed by the appellate authority of the Income Tax department. The company, which is already contesting the original demands at various levels, would also challenge it before the Income Tax Appellate Tribunal (ITAT), Golden Tobacco said in a BSE filing. "The company is likely to succeed, consequently these demand will automatically be quashed. The company will further challenge these orders also before ITAT," it said. The commissioner of Income Tax (Appeals) has confirmed penalty on the company for assessment year 1984-85 and 1986-87 totalling Rs 80.71 crore. Golden Tobacco has cigarettes brands as Panama, Taj Chhap Deluxe, Style Mini Kings, Chancellor, Platinum, Flair Kings and June Slim. It also sells cigars under the brand name of Just Black and Lips.
